Active Member –  Police and Fire New Plans

(members hired on or after November 2, 1976)

A Qualified Survivor is:

  1. Eligible Spouse/Domestic Partner: the member’s spouse/domestic partner to whom the member was married/domestic partnership for at least one full year immediately prior to his/her date of retirement who remains married to the member during retirement until the member’s death (SFERS recognizes domestic partnerships that have been established by filing a Declaration of Domestic Partnership with the San Francisco County Clerk, domestic partnerships registered with the State of California or other California jurisdictions, as well as domestic partnerships or similar legal relationships formed and recognized in other jurisdictions); or
  2. Unmarried child under age 18
  3. Dependent child of any age or
  4. Dependent parent

If You Die While an Active Employee Due to a Work-Related Cause

 green bullet If a member dies after he/she is qualified to retire, the Retirement System will pay a monthly continuation allowance to a qualified survivor equal to 100% of the monthly retirement benefit you would have received had you retired on the date of your death.
green bullet If a member dies before he/she is qualified to retire, the Retirement System will pay a monthly continuation allowance to a qualified survivor equal to the member’s compensation at the time of his/her death. This continuation allowance will be paid until the date you would have qualified for a service retirement (age 50 and 25 years of service), at which time, the monthly continuation allowance will be recalculated to be equal to 100% of the monthly retirement benefit you would have received had you retired for service on that date.
green bullet If a member dies and is not qualified for service retirement and has no qualified survivor, the Retirement System shall pay a lump sum distribution equal to the member’s contributions and interest, plus 6 months compensation earnable to the designated beneficiary, or the members’ estate.

If You Die while an Active Employee Due to Non-Work-Related Cause

 green bullet If a member dies after he/she is qualified to retire, the Retirement System will pay a monthly continuation allowance to a qualified survivor equal to 50% of the monthly retirement benefit you would have received had you retired on the date of your death.
green bullet If a member dies before age 50 but with 25 or more years of service credit, the Retirement System will pay a monthly continuation allowance to a qualified survivor equal to 50% of the monthly retirement benefit you would have received had you been age 50 and retired on the date of your death.
 green bullet If a member dies with 10 or more years of service regardless of age, the Retirement System will pay a monthly continuation allowance to a qualified survivor equal to the monthly ordinary disability benefit you would have been entitled to on the day before your death. The minimum monthly allowance is no less than 33 1/3% of the member’s final compensation at the time of his/her death.
 green bullet If a member has less than 10 years of service credit (and death was due to non-work-related cause) or does not have a qualified survivor, then a lump sum distribution equal to the member’s contributions and interest, plus 6 months compensation earnable will be paid to the named beneficiary or beneficiaries, or the member’s estate.
 green bullet If total continuation benefits paid are less than the lump sum account balance plus 6 months compensation earnable, any difference is paid in priority order to remarried spouse/domestic partner, surviving children, or member’s estate.

A continuation allowance is payable to a qualified survivor for only the period that the survivor remains qualified (e.g., the earlier of age 18 or date of marriage for an unmarried child under age 18, or until remarriage for a spouse).
